The Terms and Conditions set out below are applicable to any purchases made via this website. If you do not agree to be bound by any of these terms and conditions you may not access or use this website. Nothing in these conditions shall affect the buyer's statutory rights as a consumer.

A. Definitions

A1. "We", "Us" or "Seller" means FurnituresInc.com.

A2. "Buyer" means the person who buys or agrees to buy the Products from the Seller.

A3. "Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.

A4. "Delivery date" means the date specified by the Seller when the Products are to be delivered.

A5. "Consumer" shall bear the meaning ascribed in section 12 Unfair Contract Terms Act 1977.

All pages, documents and graphics on the Furnitures, Inc. website are copyright. You may view and display the material using a recognized World Wide Web browser. You may print out the material, provided that our URL is printed on each copy of the printout.

You are not authorised to:

• Alter the material on this website in any way.

• Copy or cut from any page or its source code for use on other websites without our permission in writing.

C. Accuracy of Furniture Product Details and Prices

We have taken the utmost care to try to ensure that details about our furniture products are as accurate as possible. We cannot be held responsible if details such as measurements, colours, prices, etc. are not exact. We try to keep the website updated, but prices may change in the store before we are able to update the website. In the event of any increase in the cost to us of raw materials, labour, overheads, or any increase in taxes or duties, or any variation in the exchange rate, we may increase the price payable under the contract having first given written notice to the buyer. If such a notice is given by us, the buyer shall have the right to cancel the order and receive back any sums they have paid. D. Payment terms

Payment of the full Price shall be due at the date of the order.

E. Warranty

E1. Subject only to the exceptions described below, all of the company's furniture has a one-year manufacturing warranty. We, in our own right do not provide any warranty cover against defects.

E2. Warranty is based upon normal wear and tear and use of the furniture in normal living environs when used in the manner for which the furniture was intended to be used.

E3. This warranty shall not apply to furniture that was improperly used, accidents, improper care, negligence or abuse, colour changes over time for whatever reason, scratches, chips, rips, tears and glass or mirror breakage or damage due to improper cleaning, improper moving of furniture from one location to another, defects arising from the natural characteristics of a source material in the furniture, slight variations in appearance resultant from climatic influences, bursting or cracking of wood due to abnormal temperature or humidity, or damage due to excessive weight placed upon the furniture.

E4. This warranty specifically excludes any defects if it was not possible by use of reasonable means to discover the existence of the defect at the time of delivery.

E5. This warranty shall only apply to the original purchaser, upon presentation of proof of purchase.

E6. Any apparent defect which exists at the time of delivery must be reported to the driver, or within seven (7) days of delivery or any warranty claim thereon is waived.

E7. Defects in part of the items delivered shall not give the customer the right to reject the entire delivery.

E8. Any defect which develops during the warranty period should be reported as soon as it develops, but in any case must be reported prior to the expiration of the warranty.

E9. Any warranty claims from the customer must be submitted to the Company in writing, with an accurate description of the nature and basis for the claim.

F. Repair Policy

The Company reserves the right to repair any defect or to replace the defective product with comparable product, as it may determine in its discretion.

G. Liability

G1. If the Buyer is dissatisfied with a purchase for any reason they may, within seven working days of delivery, contact Us to arrange collection of the goods at the Buyer's expense. Any money which you have paid, excluding the delivery cost, will be refunded within 30 days provided that the Seller receives the goods in the same condition they were in at the time of delivery to you. The Buyer's account shall then be credited with the full purchase Price of the goods. This credit may be used to buy items from the Seller's online catalogue. It may alternatively be exchanged for a refund.

G2. Insofar as is permitted by law, our only liability to you under these terms and conditions will be, at our sole discretion, to make good any shortage or non-delivery, to replace or repair any goods which are received by you in a damaged or defective state or to refund to you any sums actually paid by you for the goods in question. We will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us and will have no liability to you for any failure or delay in delivering goods or any damage or defect in goods delivered which is caused by any event or circumstance which is beyond our reasonable control. Nothing in this Clause G affects your statutory rights as a consumer.

H. Delivery

H1. Delivery of the products shall be made by the Seller or the Sellers agents notifying the Buyer that the products are available for collection at the Sellers premises or for delivery to such place as the Buyer may specify at the time the order is placed.

H2. The Seller shall use his reasonable endeavours to meet any date agreed for delivery.

H3. In any event time of delivery shall not be of the essence.

H4. The Seller shall not be liable for any delay in delivery howsoever caused.

H6. All orders for delivery to addresses within mainland GB are delivered free of charge unless stated otherwise in the catalogue or product description.

H7. For delivery to Northern Ireland, Isle of Man, Isle of Wight, Scottish Islands and Channel Islands we will deliver free to a nominated mainland GB address e.g. a port. Onward shipping from that point is the responsibility of the customer.

H8. Generally, where an order contains more than one item all items will be delivered at the same time once all items are available.

H9. The Buyer agrees to pay for any loss or extra cost incurred by the Seller through the Buyers instructions or lack of instructions or through failure or delay in taking delivery or through any acts or default on the part of the Buyer, its servants, agents or employees.

I. Acceptance of Products

I1. Other than where the Buyer acts as a Consumer the Buyer shall be deemed to have accepted the Products 5 working days after delivery to the Buyer.

I2. After acceptance the Buyer shall not be entitled to reject Products which are not in accordance with the contract.

J. Title and Risk

J1. Risk of damage to or loss of the Products shall pass to the Buyer upon delivery.

J2. Notwithstanding any other provision herein title in the Products shall not pass to the Buyer until the Seller has received in cash or clear funds payment in full.

J3. The Buyer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the Products which remain the property of the Seller, but if the Buyer does so all moneys owing to the Seller shall (without prejudice to any other right or remedy on the Seller) immediately become due and payable.

K. Privacy Policy

Customer's confidential or private information gathered by the Company is never shared with anyone, except in connection with the customer's order. Other than as described hereafter, the Company does not sell, rent, share, trade or give away any of the private information provided by our customers. However, a customer's credit card or check information is shared with the financial institutions that process the payment. Shipping information is shared with shippers that fulfill the order.

L. Proper Law of Contract

This Contract shall be governed by the law of England and Wales and any dispute, question or remedy howsoever arising determined exclusively by the Courts of England and Wales.
